Savage Law is a Law firm locatedin Whangarei. This policy outlines the way in which we manage the personalinformation we hold about our clients, potential clients, contractors andothers.

 

Savage Law is bound by thePrivacy Act 2020 (Privacy Act), including the Information Privacy Principles(IPPs) set out in Schedule 2 of that Act.

In summary, ‘personalinformation’ is information about an identifiable individual.

 

Why does Savage Law collect personal information?

 

We collect personal informationin order to conduct our business, to provide and market our services and tomeet our legal obligations, including (but not limited to)in relation to ouranti-money laundering and sanctions compliance obligations.

 

Who does Savage Law collect personal informationabout?

 

We collect and hold personalinformation about (but not limited to):

·        clients,business associates, and potential clients and their employees, contractors,owners and directors;

·        individualswe deal with in the course of acting for clients and carrying on our business;

·        suppliersand their employees and contractors;

·        prospectiveemployees, employees, and contractors; and

·        otherpeople who come into contact with Savage Law.

 

What kinds of personal information does Savage Lawcollect?

 

In general, and depending uponthe nature of the person’s connection with Savage Law, the type of personalinformation we collect and hold includes (but is no tlimited to): names,addresses, contact details, date of birth, occupations, personal preferencepayment details, employment history and/or details, education andqualifications, testimonials and feedback, nature of relationship to ourclient, evidence of source of funds (in some cases) and other information whichassists us in conducting our business, providing and marketing our services andmeeting our legal obligations.

In some cases, if personalinformation we request is not provided, it might adversely impact our abilityto supply the relevant product or service or to perform our obligations. Inparticular, if you do not provide information required for our anti-moneylaundering and identity verification obligations, we may be unable to act foryou or continue to act for you.

 

How does Savage Law collect personal information?

 

Except as otherwise permitted bylaw, we will collect personal information:

·        fromyou directly when you provide your details to us;

·        fromyou indirectly(through emails, forms, subscription applications, face-to- facemeetings, interviews, registration and attendance at seminars, business cards,telephone conversations and through the use of the services and facilitiesavailable through our websites and social media channels);

·        fromthird parties in some instances, for example:

o    we may usethird parties to analyse traffic at our websites and social media channels,which may involve the use of cookies;

o    in somecircumstances we might collect personal information about an individual from a thirdparty, such as a report provided by a medical professional or an employmentreference from another person;

o   where a thirdparty provides security-related services; and

·        frompublicly available websites.

Notificationwhen we collect your personal information indirectly (IPP 3A)

Where we collect personal information about you from a sourceother than you directly (indirect collection), we will take reasonable steps toensure you are made aware of the following as soon as reasonably practicableafter collection:

·        that yourpersonal information has been collected and the source from which it wascollected;

·        the purpose forwhich the information has been collected;

·        the intendedrecipients of the information;

·        the name andaddress of Savage Law as the agency collecting and holding the information (seeaddress details below); and

·        your rights toaccess and correct your personal information under the Privacy Act (see below).

We are not required to notify you of indirect collection wherewe reasonably believe that:

·        you are alreadyaware of the collection (for example, because the original source notified youat the time they collected the information);

·        non-notificationwould not prejudice your interests;

·        notification isnot reasonably practicable in the circumstances; or

We take reasonable steps toprotect the security of personal information. Savage Law’s personnel arerequired to respect the confidentiality of personal information and the privacyof individuals.

 

We take reasonable steps toprotect personal information held by us from misuse and loss and fromunauthorised access, modification or disclosure, for example by use of physicalsecurity and restricted access to electronic records.

 

Where we no longer require yourpersonal information, we will comply with our legal obligations in respect ofthat information.

§  birth or deathinformation recorded under the Births, Deaths, Marriages, and RelationshipsRegistration Act 1995;

§  citizenship informationrecorded under the Citizenship Act 1977; and/or

§  travel documentinformation recorded under the Passports Act 1992;and/or

·        forhealth and safety, or security purposes;

·        tocomply with our legal obligations, including (but not limited to) in relationto our anti-money laundering and sanctions compliance obligations.

 

To whom might Savage Law disclose your personalinformation?

 

We may disclose your personalinformation to:

·        othercompanies or individuals who assist us in providing services or who performfunctions on our behalf (such as mailing houses, hosting and data storageproviders, specialist consultants and barristers);

·        othercompanies or individuals who perform checks that are necessary or desirableunder law on our behalf;

·        othercompanies, agencies or individuals that maintain databases against which youridentity may be verified, which may include (but is not limited to) the NewZealand Department of Internal Affairs, New Zealand Transport Agency, and theCommonwealth of Australia Document Verification Service;

·        socialmedia sites on which we have a presence;

·        courts,tribunals and regulatory authorities;

·        anyoneelse to whom you authorise us to disclose it; and

·        wherewe are required to do so by law.

 

How can you access and correct your personalinformation?

 

We endeavour to ensure that the personalinformation we hold is accurate, complete, and up-to-date. We encourage you tocontact us in order to update any personal information we hold about you. Contactdetails are set out below. You have the right to correct any personalinformation we hold about you in accordance with the Privacy Act.

We will require you to verifyyour identity and to specify what information you require.A fee may be chargedfor providing access. If a fee is to be charged, wewill advise you of thelikely cost in advance.

 

How can you make a privacy complaint?
